1. ACCEPTANCE OF THE CONDITIONS
The customer acknowledges having read, at the time of placing the order, the particular conditions of sale stated on this site and expressly declares to accept them without reserve. The present general conditions of sale govern the contractual relations between L'Atelier des Saisons and its customer, both parties accepting them without reserve. These general conditions of sale will prevail over all other conditions appearing in any other document, except prior, express and written derogation.
2. PRODUCTS
The photos on the site are not contractual.
The availability of products is given on the site as an indication. It only becomes definitive once the order has been confirmed.
3. ORDERS
The order is made at the prices and indications displayed on the site on the day of the order. If an ordered product is not available, the customer will be informed. Before written confirmation from L'Atelier des Saisons, the orders placed by Internet do not constitute a binding contract for L'Atelier des Saisons.
4. DELIVERY
All orders placed with L'Atelier des Saisons are intended for the personal use of the customers. The customers or the recipients of the products forbid themselves any partial or total resale of the products.
All orders are delivered to the delivery address indicated by the customer. Responsibility for the goods passes to the customer upon receipt by the carrier. The delivery of the ordered goods is made by the Swiss Post. No deliveries can be made outside of Switzerland and the Principality of Liechtenstein with regard to food products.
5. PRICE
The price is expressed in Swiss francs including VAT. The price indicated on the product sheets does not include transport. The price indicated in the order confirmation is the definitive price, expressed all taxes included and including the transport and the VAT. This price includes the price of the products, the handling, packaging and conservation costs of the products, the transport and commissioning costs. The Atelier des Saisons applies a VAT of 0%.
7. PAYMENT
The price invoiced to the customer is the price indicated on the order confirmation sent by L'Atelier des Saisons. The payment is made by credit card through a bank server in a secure environment. Your credit card number is therefore directed to the bank's servers, your payment is made directly to a bank in a secure environment without passing through the shop's server, a guarantee that is all the more important as your numbers are known only to our banking partner. The order validated by the customer will only be considered effective when the bank payment centres concerned have given their agreement. In case of refusal of the said centres, the order will be automatically cancelled and the customer will be informed by e-mail. Furthermore, L'Atelier des Saisons reserves the right to refuse any order from a customer with whom there is a dispute.
8. LITIGATION
The present general conditions of sale are governed by Swiss law. The Atelier des Saisons cannot be held responsible for damages of any kind, material or immaterial, which could result from a bad use of the marketed products. The responsibility of L'Atelier des Saisons will, in any case, be limited to the amount of the order and will not be held responsible for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products. It is reminded that as a general rule and subject to the appreciation of the Courts, compliance with the provisions of this contract relating to the contractual guarantee assumes that the buyer honours his financial commitments to the seller. Complaints or disputes will always be received with attentive benevolence, good faith always being presumed in the case of those who take the trouble to explain their situations.
